These Terms govern fieldhonest.com and its magazines, tools, directories, maps, calendars, podcasts, Trophy Room, Exchange, forms, and other services (together, “Field Honest”). Field Honest is operated by Nomenas Digital LLC (“we,” “us,” or “our”). By using Field Honest, you agree to these Terms. Additional terms shown when you submit content, rate a business, claim a profile, or buy a service also apply to that activity.
Who may use Field Honest
You may browse the site at any age, but Field Honest is not directed to children under 13. You must be at least 18 and able to enter a binding agreement to submit content, list an item, claim a business, buy a service, or use a private management link. If you act for a business or another person, you represent that you are authorized to bind them.
Information, outdoor risk, and official rules
Field Honest provides general information and entertainment, not individualized legal, medical, food-safety, firearms, survival, financial, or other professional advice. Hunting and fishing rules, seasons, boundaries, access, permits, emergency orders, fire restrictions, weather, and field conditions change. Check the responsible agency, tribe, land manager, manufacturer, and qualified local professional before acting. Outdoor activity can cause serious injury, illness, property loss, or death; you remain responsible for your decisions, training, equipment, and emergency plan.
Directories and third parties
Outfitter and guide pages may begin as factual information pages assembled from public business sources. A profile, license notation, link, rating, “claimed,” or “featured” label is not our endorsement, guarantee, background check, or promise that a provider is licensed for every service, location, or date. Providers control their own services, prices, availability, contracts, permits, insurance, safety, and performance. Field Honest is not a party to a trip, guide, lodging, equipment, or other transaction between visitors and providers.
External websites, embeds, maps, payment services, and platforms have their own terms and privacy practices. We do not control them.
Exchange
The Exchange is a moderated notice board, not a dealer, broker, auctioneer, escrow service, shipping service, or party to a transaction. Buyers and sellers must confirm identity, ownership, condition, legality, age, location, shipping, transfer, and payment for themselves. Never send payment or sensitive documents until you are satisfied the transaction is legitimate. Items may not be stolen, counterfeit, unlawful, recalled, unsafe, or misleadingly described. Firearms, ammunition, regulated parts, knives, wildlife products, and other restricted items may be listed, transferred, shipped, or advertised only where lawful and through any required licensed intermediary. We may reject or remove any listing.
Accounts, links, and security
Some services use private emailed management links instead of passwords. Keep those links confidential. You are responsible for actions taken through a valid private link until you tell us it may be compromised. Do not probe, scrape at a harmful rate, bypass controls, introduce malicious code, impersonate others, or interfere with the site.
Your content
You keep ownership of content you submit. The license, promises, and removal rules in the Submission Terms apply to stories, photographs, Trophy Room entries, listings, ratings, and other submissions. You may not submit material you do not have the right to use, or material that is unlawful, deceptive, defamatory, invasive of privacy, confidential, or infringing.
Our content and marks
Except for user content and material clearly identified otherwise, Field Honest text, design, software, audio, video, graphics, and original media are owned by or licensed to Nomenas Digital LLC. You may link to pages and make limited quotations with attribution as permitted by law. Scraping, republishing, selling, training a competing content service on, or commercially exploiting substantial Field Honest material requires written permission. Field Honest names, logos, and trade dress may not be used to imply sponsorship or affiliation.
Commercial disclosures
Advertising, sponsorships, affiliate relationships, and paid partner work are disclosed as described in our Advertising & Sponsorship Policy and Affiliate Disclosure. Payment does not buy a positive consumer rating or permission to fabricate experience.
Enforcement and termination
We may investigate, edit, refuse, restrict, suspend, archive, or remove access or content when reasonably necessary for safety, accuracy, security, legal compliance, rights protection, nonpayment, or enforcement of these Terms. We may preserve records when reasonably needed for those purposes. You may stop using Field Honest at any time; separate billing and content-license provisions may survive.
Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIELD HONEST IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT CONTENT, RATINGS, PROFILES, TOOLS, LINKS, OR SERVICES WILL BE COMPLETE, CURRENT, ERROR-FREE, SECURE, OR UNINTERRUPTED, OR THAT THEY WILL PRODUCE A PARTICULAR RESULT. Nothing here excludes a warranty or right that cannot lawfully be excluded.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Nomenas Digital LLC AND ITS OWNERS, WORKERS, CONTRACTORS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, LOST PROFITS, LOST DATA, LOST OPPORTUNITY, OR LOSSES ARISING FROM A THIRD-PARTY TRANSACTION, EVEN IF ADVISED THAT SUCH LOSS WAS POSSIBLE. OUR TOTAL LIABILITY ARISING FROM FIELD HONEST WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID US FOR THE SERVICE GIVING RISE TO THE CLAIM DURING THE 12 MONTHS BEFORE THE EVENT. These limits do not apply where prohibited by law or to liability that cannot lawfully be limited.
Indemnity
If you submit content, claim a profile, list an item, or use Field Honest commercially, you will defend and indemnify Nomenas Digital LLC from third-party claims, damages, and reasonable costs arising from your content, your transaction, your violation of law, or your breach of these Terms, except to the extent caused by our own unlawful conduct.
Disputes and New Mexico law
Before filing a claim, send a written description and requested resolution to office@nomenasdigital.com and allow 30 days for a good-faith response. These Terms are governed by New Mexico law, without regard to conflict-of-law rules. Unless applicable law requires otherwise, disputes must be brought in the state or federal courts located in Bernalillo County, New Mexico, and each party consents to their jurisdiction. Either party may use an eligible small-claims court.
Changes and general terms
We may update these Terms prospectively. A material change will be identified by a new date and, where required, notice or renewed consent. The terms accepted at checkout continue to govern that purchase unless the parties agree otherwise. If one provision is unenforceable, the rest remain effective. Failure to enforce once is not a waiver. You may not transfer a paid service without our consent; we may transfer these Terms as part of a reorganization or sale of the service.
